Implied status protects temporary residents who applied to extend or change their status before it expired. If you applied on time, you can stay in Canada under your previous permit's conditions until IRCC decides. You're covered while you wait.
If you've lost your status (your permit expired without an extension application), you may still have options. Restoration of status allows you to apply within 90 days of losing status to have your temporary resident status restored. This is your second chance to maintain legal presence in Canada.
Status situations can get complicated fast. The 90 day deadline for restoration is firm and there's no extending it. If you're not sure where you stand, get professional advice now rather than hoping for the best.

Determine whether you have implied status (applied before expiry) or need status restoration (status has expired). This affects your rights and the process you need to follow.
If you need restoration, you must apply within 90 days of losing status. After 90 days, restoration is no longer possible and you may need to leave Canada to reapply.
Gather all documents supporting your case, including an explanation letter (for restoration), proof of your temporary purpose, financial support, and ties to your home country.
Fill out the correct application form for your status category (visitor, student, or worker) plus any additional forms required for restoration.
Submit your application online through IRCC portal. For restoration, pay both the $350 restoration fee and the regular application fee for your status category.
Wait for IRCC's decision. Note that during restoration processing, you do NOT have implied status and technically should not be working or studying until approved.
Not understanding the difference between implied status and restoration
Waiting too long to apply for restoration (90-day deadline)
Working or studying while in restoration status (not permitted)
Leaving Canada and expecting to return while restoration is pending
Not explaining clearly how you lost status and why
Insufficient documentation of real temporary reason for being in Canada
Applying for the wrong status category
Not paying both the restoration fee and the permit application fee
Implied status is a legal protection that allows temporary residents (visitors, students, workers) to remain in Canada under the conditions of their previous status after they have applied to extend or change their status but before IRCC has made a decision. To have implied status, you must have applied BEFORE your current status expired.
