TEMPORARY WORKERS

Every year Canada welcomes thousands of temporary foreign workers to fill the labor shortages that may be left in the market due to various reasons. These gaps in the labor market are then filled by foreign nationals that come to Canada for a limited period of time to fulfill the needs of the market. Depending on the industry or occupation that you plan to enter, you may not even need a work permit to start working in that field in Canada. Canadian Immigration Service Consultants can let you know if you qualify as a person who does not need a work permit for your particular occupation.
For the majority of occupations that do require a work permit, there are certain requirements you must meet to qualify for this permit. Below is a list of criteria that you must meet in order to qualify to work in Canada.

Basic Requirements:

1. Your employer may be required to get a Labour Market Opinion (LMO) from Human Resources and Skills Development Canada (HRSDC). An LMO confirms that there is no permanent resident of Canada that can fill the vacant position and a foreign worker may fill it.
2. An LMO is not required for all occupations and our consultants can advise you if you require an LMO for your particular position.
3. You must meet the general requirements of entering, staying and working in Canada. As a result you may be required to obtain a Temporary Resident Visa (TRV).
4. Your spouse or common law partner and your dependent children may apply to come to Canada with you.

The above requirements are a general guideline as to how you may qualify to temporarily work in Canada and they are not an exhaustive list. Depending on your unique situation the requirements can vary, however our consultants will provide you with all the information you need to make an informed decision so that we can help you start working in Canada as soon as possible.

Please keep in mind that a work permit is not an official immigration document and it does not allow you to live in Canada permanently. To live in Canada permanently you need to qualify under an immigration category. An exception to this rule applies for Live in Caregivers who meet certain requirements and may be eligible to live in Canada permanently.

Recently, there have been improvements to the Federal Skilled Worker Program with regards to the point system that is used to evaluate potential applicants. Based on extensive research conducted by the government and a thorough program evaluation, the FSWP has been re structured to meet the ever changing climate of Canada’s economy and long term prosperity. Not only have these changes improved Canada’s ability to differentiate between potential immigrants that are better suited to work here, but the new changes also ensure that these immigrants will also be better positioned for success. As a result, this new program will help adapt to Canada’s changing labor market needs and help fill the gaps left by the natural labor market in Canada, without placing a burden on our society. There are a number of different criteria that are measured to evaluate your eligibility. Below is a list of the basic requirements to qualify under the FSWP.

Basic Requirements:

  1. One year of continuous work experience

  2. You must meet the minimum language requirement

  3. You must meet the minimum education requirement

  4. You must obtain the minimum score based on the six selection factors in the skilled worker points grid

  5. You must provide proof of funds available to support yourself and your family once you arrive in Canada

  6. You must not be inadmissible for any reason (criminal, health, public safety, etc.)

 

These are the basic requirements against which you will be assessed to determine if you will be an eligible candidate for the Federal Skilled Worker Program in Canada. The new changes that have been implemented to the FSWP will ensure that only those individuals that will be able to integrate rapidly and successfully in to Canada’s economy are selected. This will also benefit successful applicants as they will have an easier time adjusting to Canadian society and being productive workers in the labour force.
